Losing the title to your boat or outboard motor can feel like a dead end, but in Texas, there’s a legal solution: the bonded title. This process lets you claim ownership when the usual paperwork is missing or incomplete. Whether you’re in Beaumont, Lumberton, or anywhere across the state, understanding how a bonded title works can save you time, stress, and money.
This guide explains what a bonded boat title is, when you need one, and how the Texas Parks and Wildlife Department (TPWD) requires you to apply.
What Is a Bonded Boat Title in Texas?
A bonded boat title is a certificate of title issued by TPWD that’s backed by a surety bond instead of traditional ownership documents. It’s legally valid and allows you to register, insure, and sell your boat.
Here’s the key: in Texas, both the vessel (boat) and the outboard motor (if it’s 25 horsepower or greater) are titled separately. That means if you’re missing paperwork for both, you’ll need two bonded titles, one for the vessel and one for the motor.
The surety bond provides financial protection in case another person proves they are the rightful owner within the bond period. Without this safeguard, TPWD won’t issue a title when standard paperwork is missing.
When Do You Need a Bonded Title?
You’ll need a bonded title in Texas if you can’t get a normal title through standard paperwork. Common situations include:
- Lost or missing title: You or the previous owner misplaced it, and no duplicate can be obtained.
- Bought a boat without proper paperwork: Seller didn’t provide a title or it wasn’t correctly signed over.
- Inherited or gifted boat: No title was ever provided or transferred.
- Abandoned boat: Left on your property, with no clear chain of ownership.
In all these cases, TPWD requires you to follow the bonded title process to establish legal ownership. You can apply here online.
How to Get a Bonded Boat Title in Texas (Step-by-Step)
The process is detailed but straightforward if you follow the steps:
1. Gather Proof of Ownership
Collect any documents that show you obtained the boat legitimately — such as a bill of sale, invoice, or canceled check. TPWD requires some form of evidence.
2. Request Ownership History
- For boats titled in Texas: request an Ownership/Lien Holder Printout (PWD 763).
- For boats titled in another state: obtain ownership verification from that state.
This report shows the last recorded owner and any liens.
3. Contact Previous Owners and Lienholders
Send certified mail using TPWD’s Request for Release of Ownership Interest (PWD 1347) to the last recorded owner(s) and lienholders. You must allow at least 30 days for a response. Keep copies of all correspondence.
4. Apply for Bonded Title Review
Complete the Statement of Fact for Bonded Title (PWD 388) and submit it with:
- Your proof of ownership
- Certified mail receipts
- Lien releases (if applicable)
- A standard title application form (PWD 143 for vessels / PWD 144 for outboard motors)
Mail the packet to TPWD in Austin. Do not purchase a bond yet — wait for TPWD’s approval.
5. Receive TPWD Approval and Bond Amount
If your case qualifies, TPWD sends you an approval letter stating:
- Whether you need a bond for the vessel, motor, or both
- The bond amount required (set at 1.5× the appraised value of each unit)
Example: if your boat is valued at $8,000, your bond amount will be $12,000. If the motor is also valued separately at $4,000, a second bond of $6,000 is required.
6. Purchase the Surety Bond(s)
Take TPWD’s bond form(s) to a licensed surety bond provider. You’ll pay a bond premium (a percentage of the bond amount) to secure the bond(s). The premium is not refunded but is a one-time cost.
7. Submit Final Documents and Fees
Send the completed bond(s) and required TPWD fees (including the $37 bonded title application fee per unit) to Austin. TPWD will then issue your bonded title(s).
How the Bond Works
Bond Duration: Valid for three years.
Protection: Covers previous owners or lienholders with valid claims.
After Three Years: If no claims are filed, the “bonded” notation is removed, and your title becomes a standard Texas title.
